The appellant never made any promise to supply the gas to the writ-petitioner and as such question of legitimate expectation does not arise at all by virtue of the license issued by the Bangladesh Energy Regulatory Commission for Generation of Electricity in Ishwardi EPZ. No vested and legal right has been created in favour of the writ-petitioner. As such the direction upon the writ-respondents by the High Court Division to provide gas connection to the writ-petitioners is beyond the scope of law.
