National Human Rights Commission Act, 2026: Stronger Remedies and Conditional Independent Investigation

The National Human Rights Commission Act, 2026 replaces the 2009 Act while continuing the Commission and preserving specified proceedings and staff arrangements. It introduces five full-time commissioners, a public nomination process, structured complaint procedures, compensation and recovery powers, protective orders, and a National Preventive Mechanism Unit. Its central accountability question concerns section 19: complaints against disciplined forces initially follow an internal reporting procedure, but an inadequate response to recommendations can activate the ordinary complaint process. This scrutiny examines that conditional route, its gaps, and the safeguards required when the Commission exercises coercive powers.

Source, commencement and the limits of verification

Analysis date: 2 November 2026. The instrument is the জাতীয় মানবাধিকার কমিশন আইন, ২০২৬, Act No 106 of 2026, described here in English as the National Human Rights Commission Act, 2026. The Gazette records presidential assent and publication on 8 September 2026. Section 1(2) provides immediate commencement, without a further notification or a deferred commencement for particular sections. This is an enacted Act, not a Bill or the similarly named 2025 Ordinance. Section 41(1) repeals the 2009 Act. The official database also marks that earlier Act as repealed. [1]–[3]

The legislative sequence matters. Act No 46 of 2026, assented to on 10 April 2026, revived the 2009 Act and repealed the relevant 2024 and 2025 ordinances, including the 2025 amendment. Its section 2 expressly restored the 2009 Act in the same manner. The September Act is a separate enactment whose section 41 again repeals the 2009 Act. Powers found in the repealed 2025 Ordinance cannot therefore be inserted into this Act merely because the instruments share a subject. [1], [3], [4], [10]

The text array reproduces the complete supplied Ministry HTML source, including its title, date, preamble, chapter headings and all 42 sections. Its 232 operative paragraph blocks were compared with the official HTML print view. Source spelling, punctuation, unlabelled paragraphs and awkward wording are retained; only mechanical HTML whitespace is normalised and printed labels are separated into the number field. The supplied HTML contains no schedules, tables, forms or substantive footnotes. The linked Gazette PDF was visually checked for identity, assent, the central remedial and disciplined-force provisions, and the concluding provisions. Its extracted text has defective font encoding, so it was not used as an unchecked OCR transcription. This is a reproduction of the identified HTML version, not a claim of character-for-character collation of every Gazette page. These source notes and the English commentary are editorial, not enacted text. [1], [2], [11]

The Ministry text, its print view, the official 2026 enactment list and targeted searches of official sources disclosed no subsequent amendment or repeal of Act No 106. That is a bounded verification result, not a guarantee that every later Gazette or delegated instrument has been indexed. No amendments have been silently consolidated. No official English translation, implementing regulations, appointment notification, operational statistics or judgment interpreting this Act was verified. Accordingly, the conclusions below are reasoned statutory interpretations, not reported judicial holdings; section 42 itself gives the Bengali Act priority over a conflicting English text. [1], [10]

What changes, and whose interests are affected

The Act strengthens both institutional capacity and remedies. Compared with the 2009 Act’s chairperson and up to six members, only two of whom were full-time, section 5 establishes a chairperson and four commissioners, all full-time. Sections 7–8 expand participation in selection and require public applications or nominations. Sections 14–16 establish a sequenced complaint, investigation and hearing process. Sections 16, 18, 24 and 27 combine remedial directions, urgent protection, recovery and compliance duties. Section 33 adds a dedicated preventive visiting unit. The older law already permitted investigation, mediation and recommendations; the change is therefore not the invention of oversight, but the addition and restructuring of particular powers and procedures. The definition of person in section 2(জ), read with section 13(ক), reaches individuals and a broad range of public and private organisations. Section 2(ঝ) recognises constitutionally or statutorily guaranteed human rights, rights in ratified international instruments enforceable through domestic law, and customary international human rights consistent with domestic law. Ratification alone does not satisfy the definition’s additional enforceability requirement. Section 13(ছ) confirms that distinction by separately authorising recommendations to extend the enforceability of rights outside the definition. The Commission may advocate wider protection, but it cannot treat every desirable international standard as an existing coercively enforceable entitlement. Nor does this definition expressly displace Article 8(2)’s non-enforceability of Part II. [1]; Constitution, art 8(2) [5]

Section 19 permits conditional independent investigation

The answer to the question is yes, on the better reading, once the conditions in the proviso to section 19(4) are met. Section 19(1), operating notwithstanding the Act’s other provisions, first channels complaints against a disciplined force or its member into a report from the relevant organisation or institution. Under subsection (3), a satisfactory report ends further action; an unsatisfactory report requires recommendations. Subsection (4) then requires the institution to report its action within 45 days of receiving those recommendations. Failure to report within that period, or action the Commission considers unsatisfactory, permits the Commission to proceed on its own initiative under the provisions governing complaint disposal. Those are alternative triggers. [1]

A restrictive reading would allow only recommendations based on the force’s own account, even after escalation. Its strongest argument is that section 19 uses an overriding clause and refers to complaint disposal rather than expressly naming investigation under section 15. However, section 16’s disposal procedure begins with an investigation report, permits further investigation, and requires notice and a hearing before adverse final findings. Applying its remedial stages while forbidding the evidential process necessary to reach them would deprive the proviso of much of its practical effect. Read together with sections 13(ক), 15 and 21, the proviso is better understood as reopening the ordinary investigative and adjudicative machinery when internal accountability fails. This construction gives effect to both the initial exception and its express corrective proviso. [1]

The comparison with section 18 of the 2009 Act supports this reading. That provision required a government response within six months of recommendations but contained no equivalent express escalation proviso. The 2026 Act replaces that interval with 45 days, addresses the relevant organisation directly and adds the corrective route. Treating the Commission as permanently confined to internal reporting would erase a material textual difference between the two enactments. Conversely, treating section 19 as permitting an unrestricted ordinary investigation from the outset would disregard the retained special sequence. Independence is enlarged, but procedurally conditional. [1], [3]

The scope of this condition is substantial. Section 2(ণ) includes police, armed forces, intelligence and government investigative agencies, the Rapid Action Battalion and specified other bodies. The statutory definition governs this Act; it should not be assumed identical to every constitutional use of disciplined force. Article 45 concerns particular provisions of disciplinary law limited to proper performance of duties or maintenance of discipline. It does not, by its wording alone, establish general immunity from scrutiny for violations against civilians. That observation does not decide every possible jurisdictional dispute, but it defeats an unsupported claim that force membership itself extinguishes accountability. [1]; Constitution, art 45 [5]

The initial-report gap and urgent protection

Section 19(2) requires the first report within a period fixed by the Commission. Yet the express escalation proviso is attached to the later response to recommendations under subsection (4). If the institution withholds the first report, the Act supplies no equally explicit shortcut into the ordinary process. Section 27 can support an order compelling compliance, but a power to require a report is not the same as an unambiguous power to bypass the report stage. The strongest defence is that section 19 preserves an opportunity for specialist internal action and the Commission controls the initial deadline. That explains sequencing; it does not answer deliberate non-cooperation. An amendment should expressly permit direct investigation when the first report is withheld, evidence is endangered or delay threatens serious harm. This is a drafting gap, not proof that the whole provision is invalid. [1]

Section 18 authorises urgent assistance and protection during investigation; section 26(2) separately permits confidentiality and protection orders without expressly imposing that same investigation-stage condition. Those protections should be considered promptly where retaliation is threatened. Nevertheless, the effect of section 19’s overriding opening on investigative interim measures is contestable and should not be concealed. A reasoned protective order must identify its legal basis and its relationship to the special procedure. Section 33’s preventive visiting function has a separate purpose, discussed below; using a complaint sequence to suspend all routine detention monitoring would go substantially further than regulating the determination of a particular allegation. [1]

Access to complaints, limitation and reasons

Section 14 permits written, oral and other prescribed complaints without a fee, including complaints made for a victim. Its six-month limit expressly applies to the complaint route in paragraph (ক); the extension proviso recognises incapacity, intimidation, special circumstances and reasonable public-interest grounds. The own-motion route in paragraph (খ) is not expressly given that limit. Applying the six months automatically to both routes would extend the proviso beyond its stated object. Equally, own-motion action remains subject to jurisdiction, fair procedure and section 19 where applicable. Accessibility is a real statutory gain, especially for people unable to prepare formal pleadings. [1]

The short limitation period may disadvantage a person emerging from coercive custody, but the strongest defence is the unusually broad power to excuse delay. The correct initial response is therefore a reasoned exercise of that power, not a declaration that every older complaint is barred or that the period is inherently unconstitutional. Section 15(1) also requires a hearing and written reasons before a complaint is closed as initially baseless. Its reconsideration window is tied to expiry of the initial 15-day period, which may be difficult where the victim receives late notice. Timely communication of decisions is essential; legislative revision should expressly connect review time to effective notification rather than leave access dependent on administrative speed. [1]; Constitution, art 31 [5]

Referral and compensation are not interchangeable remedies

Section 16(5) separates two remedial routes. Paragraph (ক) requires referral where the matter appears to involve a non-compoundable criminal offence, or where a court or other institution can provide a more effective resolution. Paragraph (খ) applies outside paragraph (ক), allowing recommendations for departmental, disciplinary or remedial measures and requiring implementation within two months, subject to its reconsideration mechanism. Calling every recommendation merely advisory would ignore that mandatory implementation language. However, section 27’s general compliance power cannot erase the express allocation of cases between paragraphs (ক) and (খ). [1]

The second proviso to section 16(5)(খ) permits compensation of twice the assessed actual loss or more, payable to the victim or lawful representative. It does not establish a ceiling of twice the loss. Its placement also matters: it supplements action under paragraph (খ), rather than expressly authorising the same award in every case referred under paragraph (ক). The strongest defence of this separation is that serious criminal matters belong before courts and parallel adjudication may conflict. Its weakness is that criminal responsibility and victim reparation answer different questions. The Commission should not invent a concurrent compensation jurisdiction to repair that policy choice. Parliament should clarify whether a distinct reparative award can accompany criminal referral and how double recovery is prevented. [1]

The open-ended uplift requires separate reasons for the actual-loss finding and the additional amount. Evidence of medical costs, lost income and other proved harm must support the former; the purpose and scale of any enhancement must support the latter. The Act does not comprehensively specify valuation of non-financial injury, standards for enhancement or an express upper limit. Deterrence and serious harm provide a substantial defence of the power, but cannot justify unexplained differences between comparable victims or respondents. Transparent criteria are needed to make the discretion consistent with equality and treatment according to law. Section 17(4), by contrast, provides appropriate compensation to give effect to settlement and should not be described as automatically attracting the section 16 uplift. [1]; Constitution, arts 27, 31 [5]

Compliance, attributed responsibility and imprisonment for default

Section 27 makes lawful Commission orders obligatory. Its reference to any lawful measure against a non-employed individual does not create an unspecified criminal offence or authorise an invented punishment. Likewise, section 38’s adoption of Penal Code offences and Criminal Procedure Code processes is not an unlimited contempt jurisdiction. The incorporated offences and their procedural conditions still matter. Protecting investigations from obstruction is a legitimate purpose, but sanctions must remain traceable to enacted authority. [1]; Code of Criminal Procedure 1898, ch XXXV [6]

Section 27(3) attributes an institution’s failure to identified office-holders unless they prove lack of knowledge or due diligence. That can prevent an institution from defeating orders through organisational opacity. Its reach nevertheless requires care: the Commission should establish the relevant institutional breach and the individual’s statutory position, disclose the case to be answered, and genuinely consider the defence. It should not treat the entire list of owners and managers as an automatic collective penalty. The provision’s reversal concerns responsibility for non-compliance; it does not eliminate the need to prove the underlying facts or supply a sentencing power that the Act does not otherwise confer. [1]; Constitution, art 31 [5]

Section 24 allows compensation recovery from property, using a first-class magistrate or collector and the processes in sections 386–387 of the Criminal Procedure Code, with a separate public-demands route. Section 24(2) also permits the magistrate to order imprisonment for up to three months or until payment, whichever occurs first. This is not imprisonment that the Commission itself may order for a human-rights finding. The recovery provisions incorporated from the Code include property processes and a prohibition on arrest or detention in executing the collector’s warrant under section 386(3). The Act’s express magistrate power must therefore be kept distinct from the collector’s recovery role. Given Articles 31–32, default detention demands notice, an opportunity to contest the legal basis and amount, and a reasoned consideration of the circumstances of non-payment. Recovery efficiency is the strongest defence; detention merely because a person lacks resources remains a serious rights concern. The statute does not expressly set out an inability-to-pay test, making legislative clarification preferable to claiming that the safeguard is already written into it. [1], [5], [6]

Investigation, hearing, evidence and reconsideration

Sections 15–16 distinguish preliminary investigation from final disposal. A favourable investigation report is not itself a final finding against the respondent: section 16(2)(গ) requires notice, and subsection (3) requires a hearing, including properly notified proceedings in a party’s absence. Section 15(3) makes culpable investigative delay relevant to service accountability. That provision should not be treated as automatically punishing every overrun: the Commission must first conclude that the investigator was responsible. Nor does the Act expressly extinguish a victim’s complaint merely because an officer misses a deadline. Procedure should advance a lawful determination rather than transfer official failure to the complainant. [1]

Sections 16(7) and 28(2) make Commission reports evidence in the relevant proceedings under the Evidence Act. Neither declares those reports conclusive proof or substitutes a Commission finding for the criminal court’s determination of guilt. Section 22(2) additionally protects statements given before the Commission against proceedings or use against their maker, while retaining liability for false evidence. These provisions must be read together: transferring a report cannot lawfully become a device for circumventing a witness’s statutory protection. The authority receiving it must distinguish admissible material, its weight and any protected statement. [1]

Section 29 permits one reconsideration application within 30 days, except for the special routes under sections 15(1) and 16(8), which use shorter periods. Section 16(8) is textually awkward: it refers to both closure and taking cognisance but later describes reconsideration of the closure order. Its opening words support access for an affected complainant or respondent, yet the discrepancy should be clarified rather than silently edited. Reconsideration by the same institution offers correction but no independent statutory merits appeal. That absence is a policy weakness where awards and recovery can be severe; it is not automatically invalidity. Articles 44 and 102 preserve constitutional remedies within their own conditions, and statutory finality in section 15(1) should not be read as an amendment to those constitutional powers. Judicial review is also distinct from rehearing every factual dispute on appeal. [1]; Constitution, arts 44, 102 [5]

Arrest, inspection and pending court proceedings

Section 15(4) confers investigative powers by reference to the Criminal Procedure Code. The specific arrest provision in subsection (5) concerns an allegation involving events for which a cognisable criminal case has already been instituted; it requires handover to police and continued monitoring. The safest construction gives that specific condition real effect rather than using subsection (4) to make every human-rights complaint independently arrestable. Investigation powers remain constrained by Articles 31–33 and applicable criminal procedure. The Act’s protective purpose cannot excuse unlawful detention by its own investigators. [1], [5], [6]

Section 21(3) permits visits at any time without prior permission or notice, notwithstanding other laws. Surprise access can be indispensable where advance notice would conceal abuse. However, the power is expressly for carrying out statutory functions, not a general licence to enter any private premises for unrelated purposes. Article 43 makes the relationship between entry into a citizen’s home and a reasonable restriction a material issue; necessity, statutory purpose and the scope of the visit require justification. Section 28 separately restricts investigation of a matter pending before a court unless that court approves it. A police case and a matter actually pending before a court should not be assumed identical without examining the procedural stage. Where judicial proceedings are pending, investigators should obtain the required approval, while recognising the distinct court-reference route under section 20. [1]; Constitution, arts 31–33, 43 [5]

Independence depends on appointments, removal and resources

Section 3(2) expressly requires independence and complete impartiality. The Act supports that duty through full-time membership, experience requirements, public nominations, removal protections and mandatory recusal under section 39. Nevertheless, the ten-person selection committee under section 7 has a five-person quorum without a requirement that particular independent or opposition participants attend. A numerically sufficient meeting can therefore exclude several perspectives the full membership was designed to include. The strongest defence is that quorum and majority decision prevent vacancies or absence from paralysing appointment. That is legitimate, but publication of assessment criteria, shortlist reasons and conflict declarations would make the public nomination process more than a formal invitation. These are safeguards proposed here, not requirements expressly contained in section 8. [1]

Section 6(5) permits appointments for up to five years, rather than fixing every appointment at five years. Short initial terms and the prospect of a second term can create dependence even though more than two combined terms are prohibited. Section 9(1) borrows the judicial removal procedure, but subsection (2) supplies specific exceptions, including a disqualification arising under section 6(4). Those exceptions must be established on evidence through lawful procedure. A substantiated disqualification differs from executive dissatisfaction with an unwelcome investigation. The statutory independence requirement is an important interpretive constraint; it does not justify pretending that the express exceptions do not exist. [1]; Constitution, art 31 [5]

Government controls remain in section 4’s approval of additional offices, section 30’s approved staffing structure and interim service conditions, and section 35’s spending rules. Section 30(4)’s 30 per cent ceiling on deputation and section 35’s freedom to spend approved allocations without separate prior approval are counterweights. Public funding and audit are defensible accountability mechanisms; they do not prove capture. The concern arises if staffing approval, expenditure rules or delayed release of funds are used to obstruct the Commission’s statutory functions. Such application would conflict with section 3(2). Independence and public audit must coexist, as sections 35(2) and 36 expressly recognise. [1]

Section 33 requires a National Preventive Mechanism Unit, with regular unannounced visits, access to detention information, confidential interviews and follow-up recommendations. Its locations include police stations, transport vehicles, mental-health institutions and care settings, not merely prisons. Reading this preventive mandate as available only after a complaint survives section 19 would conflate identifying systemic risks with determining an individual force member’s liability. The contrary argument relies on section 19’s overriding language. The better reconciliation confines that special sequence to the complaints it expressly addresses, preserving section 33’s separate visiting function and the section 21 powers expressly incorporated by subsection (5). The Act should state that relationship more clearly. [1]

The UN depositary records Bangladesh’s accession to OPCAT on 17 July 2025. Articles 18–20 of that treaty require independence, adequate resources and access sufficient for preventive work; article 21 protects information and informants, and articles 22–23 address dialogue and public reporting. These are treaty standards relevant to section 33’s expressly stated purpose, not domestic appellate holdings. International obligation, statutory implementation and an individual’s domestic cause of action remain distinct questions. The depositary check supports treaty participation; this post does not purport to verify a separate formal designation or every implementing measure. [7], [8]

Section 33(8) expressly requires resources sufficient for effectiveness and independence. Yet subsection (6) makes implementation of the Unit’s recommendations dependent on Commission approval, and subsection (10) permits government visiting and investigation policies. Coordination within the Commission is a strong defence of that arrangement; operational veto over visits or suppression of findings would be much harder to reconcile with the preventive function. The Subcommittee’s guidance specifically supports operational autonomy and separately protected resources where an NPM sits within a human-rights institution. That guidance is persuasive treaty-body interpretation, not a binding Bangladeshi judgment. Policies and internal arrangements should preserve independent access, work planning and confidential contact with the Subcommittee, rather than make statutory monitoring depend on permission from the institution being monitored. [1]; OPCAT, arts 18, 20 [7]; SPT annual report, annex I(A), paras 3–7 [9]

Delegation must preserve the Act’s allocation of decisions

Section 37 permits delegation of any Commission power to the listed office-holders and staff, subject to conditions, while section 40 permits gazetted regulations for the Act’s purposes. Their breadth must be read with provisions assigning preliminary decisions to an authorised commissioner and final hearing functions to the Commission. One possible reading permits delegation of even final remedial powers; another treats the specific collective procedure as a limit on that general wording. The Act does not expressly settle every boundary. A delegation should identify the function, delegate, limits and supervision, rather than assume that a general authorisation erases notice, hearing or recusal duties. [1]

Regulations under section 40 and government policies under section 33(10) cannot amend the parent Act, expand compensation into a jurisdiction excluded by section 16, create new imprisonment powers or remove the Unit’s express access rights. Administrative detail and specialist expertise provide the strongest defence of delegation. The legal limit is the authority actually conferred, read with the Constitution. Publication, clear allocation of functions and reviewable reasons would allow delegated power to work without obscuring responsibility. Whether a particular measure exceeds that authority can only be decided from its actual terms; no unverified regulation is pronounced unlawful here. [1]; Constitution, arts 7(2), 26, 31 [5]

Public reporting must not expose the people it protects

Section 16(6) requires online publication of complaints, report summaries, decisions and remedies. Section 25 requires an annual report by 31 March, online publication within seven days of submission and an inclusive consultation. These duties can expose non-implementation. Read alone, however, complaint publication could reveal a threatened witness, child or survivor. Section 26’s confidentiality and protection powers supply the internal safeguard: publish the substantive accountability record while withholding identifying details where protection requires it. For preventive information, OPCAT article 21(2) additionally requires express consent before publishing personal data. Transparency is the strongest defence of publication; it does not require avoidable identification of vulnerable people. This is a reconciliation of concurrent duties, not a licence to suppress adverse findings under an undefined claim of confidentiality. [1], [7]

Continuity, constitutional assessment and the answer

Section 3 continues the existing Commission and section 41 preserves specified prior acts, measures, proceedings and staff continuity. Pending proceedings are to be disposed of as proceedings under the new Act. Those savings prevent repeal from becoming an automatic administrative reset. They do not expressly answer every question about applying a newly enlarged monetary liability to conduct completed before commencement. Continuation of a file and retrospective enlargement of liability are different propositions. Any such award needs a specific temporal justification, especially where punitive consequences are alleged; the saving clause should not be treated as an unrestricted retrospective penal provision. [1]; Constitution, art 35(1) [5]

On balance, section 19 authorises an independent investigative route after the institution fails to report action within 45 days of recommendations or takes action the Commission reasonably finds unsatisfactory. That interpretation follows the proviso’s wording, the evidential structure of section 16 and the contrast with the repealed 2009 procedure. It does not remove the initial internal-report sequence or cure its silence about a missing first report. The Act’s principal gains are enforceable remedial machinery, accessible complaints and preventive access. Its principal weaknesses are conditional access to ordinary investigation, uncertain remedial boundaries and insufficiently specified safeguards for coercive powers. Those defects justify interpretation, disciplined administration and targeted reform. Constitutional invalidity would require a demonstrated inconsistency with an applicable constitutional provision, assessed under Articles 7(2) and 26; neither institutional imperfection nor policy disagreement supplies that conclusion by itself.
