Therefore, this reference is rejected. The appeal is allowed. The judgment and order of conviction and sentence passed by the learned Judge of the Tribunal convicting the condemned-prisoner under section 11(Ka) of the Ain, 2000 sentencing him thereunder to death with fine is hereby set aside. The condemned-prisoner is acquitted of the charge levelled against him. The concerned authority is directed to release the condemned-prisoner Md. Moshiur Rahman Sukhan, son of late Hafizur Rahman, House 20, 5th Floor, Road 04, Sector-13, Police Station-Uttara Paschim, District-Dhaka from jail forthwith, if not wanted in any other cases.
