The cardinal principle embodied in Section 28 of the Registration Act, 1908, as well as the law settled by our Apex Court in Syed Kausar Ali v. Gahar Kazi and others, 37 DLR (AD) 177, is that every document affecting immovable property must be registered in the office of the Sub-Registrar having territorial jurisdiction over the property. Where registration is procured by the inclusion of a non-existent, fictitious, or insignificant parcel of land solely for the purpose of creating territorial jurisdiction, such registration cannot prejudice the rights of a person who was not a party to the document and who acquired rights in the property without notice of the transaction. Such conduct constitutes a fraud upon the Registration Act, and any registration obtained by such means is void and of no legal effect.
