Court index description
After passing the standing order High Court Division became functus officio, as such, cannot recall its order lawfully. Though there was nothing legally incorrect in the impugned judgments and orders of both of the Divisions of the Supreme Court of Bangladesh, nevertheless, it is easily understandable that justice has been defeated in this whole process…we decide to condone the delay of 11 days and consider the Civil Petition for Leave to Appeal at least for doing complete justice in exercise of its power under Article 104 of the Constitution. The earlier judgment of Appellate Division is reviewed.
