Therefore, the reference is rejected. Criminal Appeal 8670 of 2019 is also dismissed. But the sentence of death awarded to the condemned-prisoner is commuted to imprisonment for life. The Jail Appeal is accordingly disposed of. The condemned-prisoner shall get the aid of section 35A of the Coe of Criminal Procedure. The condemned-prisoner is to be shifted from condemned-cell to the cell meant for the prisoners alike.
